This Privacy Notice has been prepared by Tre Mari Bakery, (“we”, “us”, “our”). This Privacy Notice sets out the manner in which Tre Mari collects, uses, discloses and otherwise manages the personal information of its customers (“you”, “your”).

This Privacy Notice applies to the privacy practices at our Tre Mari Bakery Store and Online Shop (“Stores”), on our websites located www.tremaribakery.ca, www.shop.tremaribakery.ca, and (“Websites”), and other interactions with our customers.

WHEN YOU ACCESS THE SITES, YOU AGREE TO THIS PRIVACY POLICY AND CONSENT TO BE BOUND BY ITS TERMS. YOU CAN WITHDRAW YOUR CONSENT AT ANY TIME BY CONTACTING OUR PRIVACY OFFICE, AS DESCRIBED BELOW. IF YOU CHOOSE TO WITHDRAW YOUR CONSENT, WE MAY NOT BE ABLE TO PROVIDE YOU WITH THE SERVICES OR COMMUNICATIONS THAT ARE AVAILABLE FROM US. IN ADDITION, IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, OR TO ANY CHANGES WE MAY SUBSEQUENTLY MAKE, YOU SHOULD STOP ACCESSING THE SITES.

Tre Mari Bakery is subject to the Personal Information Protection and Electronic Documents Act and applicable Canadian provincial privacy legislation. Privacy laws vary by jurisdiction. You acknowledge and agree that access to the Websites and the services that are available through the Sites are provided via the Internet and that your information, including personal information, may be transferred across national borders and stored or processed in accordance with the terms and conditions of this Privacy Policy.

COLLECTION AND USE OF PERSONAL INFORMATION

The term “personal information” means information about an identifiable individual, including name, address, email address, phone number, and other information relating to an individual. We may collect personal information when you:

  • Purchase or return merchandise at our Stores.
  • Purchase one of our gift cards on-line or in store.
  • Consent to receive promotional emails and other communications.
  • Visit or register on our Websites.
  • Apply for employment.

SHOPPING WITH US

You do not have to provide us with any personal information when you purchase merchandise with cash at one of our Stores. If you use a credit or debit card for your purchase in store, we collect your debit or credit card-related information to process and administer your payment. When you purchase one of our products on-line, your name, billing address, the address for delivery, phone number, email address, credit card information, amount of the purchase, and a username are collected. This information is used to process and fulfill your online order.

MERCHANDISE RETURNS

For merchandise returns where a customer receives a refund on a debit or credit card, we will collect and use debit and credit-related information to process and administer the refund transaction.

EMAIL AND OTHER COMMUNICATIONS

From time to time, we may collect certain personal information (such as first and last name and email address) to send you email and other communications about products, jobs, services, promotions or events that may be of interest to you about Tre Mari Bakery. You can opt-out of receiving promotional email from us by doing one of the following:

  • If you have received an email, you can follow the opt-out or “unsubscribe” instructions provided in your email.
  • Contact our store 416-654-8960 or send an email to catering@tremaribakery.ca.

ONLINE REGISTRATION

You do not have to register to visit our Websites. Some of the features offered through our Websites may require you to register and provide your name, address, phone number, email address, and a password that you select. Your registration information is used to provide and otherwise administer the service you requested.

EMPLOYMENT WITH US

In connection with a job application or related inquiry, you may provide us with certain personal information about yourself (such as that contained in a resume, cover letter, or similar employment-related materials). We use this information for the purpose of processing and responding to your application for current and future career opportunities.

CUSTOMER SERVICE

When you contact our Store, communicate with a member of management or Associate in a Store or otherwise contact us or one of our service providers with a comment, question or complaint, you may be asked for information that identifies you (such as your name, address and a phone number) along with additional information we need to help us promptly answer your question or respond to your comment or complaint. We may also retain this information to assist you in the future and to improve our customer service, product and service offerings, and events and promotions.

DISCLOSURE OF PERSONAL INFORMATION

We will not disclose, trade, rent, sell or otherwise transfer your personal information, without your consent, except as otherwise set out herein.

CHILDREN'S PRIVACY AND AGE LIMITATIONS FOR THE SITES

The Sites are intended for use by persons aged 16 or older, and by your use of our Websites you affirm that you are at least 16 years of age. We do not knowingly collect personally identifiable information from children under the age of 16. If we discover or are made aware that we have received personally identifiable information from an individual who indicates that he or she is, or whom we otherwise have reason to believe is, under the age of 16, we will delete such information from our systems. If you are a parent or guardian of a child under the age of 16 and believe he or she has disclosed personally identifiable information to us, please contact us as provided below. In any such event, a parent or guardian of a child under the age of 16 may review and request deletion of such child's personally identifiable information as well as prohibit the use thereof.

SERVICE PROVIDER ARRANGEMENTS

We may transfer (or otherwise make available) your personal information to our affiliates and other third parties who provide services on our behalf. For example, we may use service providers to authorize and process payments, host our Websites, operate certain of its features, serve advertisements, send email, or other communications, run our contests and promotions, conduct customer research, manage and analyze data and our advertising effectiveness, and fulfill gift card orders.

LEGAL, COMPLIANCE AND LOSS PREVENTION

Tre Mari Bakery may provide your personal information in response to a search warrant or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required or permitted by applicable Canadian, US or other law. We may also disclose personal information where necessary for the establishment, exercise or defense of legal claims and to investigate or prevent actual or suspect loss or harm to persons or property.

COOKIES

As with many websites and applications, the Site uses “cookies” – small strings of data placed on users' personal computer hard drives during the exchange of data that happens when your browser points to one of our websites. Among other things:

  • Cookies enable a site or application to identify a user's browser as a previous visitor by means of a unique string of numbers assigned on a previous visit;
  • Cookies assist us in collecting information on the pages of our Sites that you access or visit, and in recording any preferences you indicate for use on our Sites;
  • If you are browsing one of our Sites, a cookie identifies your browser and Site user ID and internet protocol number of your computer or other access device (but not your personal identity); and
  • If you place orders with us or use our loyalty program, we use cookies to assist in storing your preferences and recording other session information (a "session" is a single visit by you to one of our Sites).

By visiting our Sites you acknowledge, understand and agree that you are giving us your consent to track your activities through the use of cookies and other tracking technologies provided by our third-party service providers.

SECURITY OF PERSONAL INFORMATION

We have implemented measures designed to protect personal information in our custody and control, including appropriate measures to protect the safety of credit and debit cards and other transactions in our Stores. We maintain reasonable administrative, technical and physical safeguards in an effort to protect against unauthorized access, use, modification and disclosure of personal information in our custody and control. Unfortunately, no collection or transmission of information over the Internet or other publicly accessible communications networks can be guaranteed to be 100% secure, and therefore, we cannot ensure or warrant the security of any such information.

Your personal information may be protected with a password you select. We strongly recommend that you do not disclose your password to anyone. We will never ask you for your password in any unsolicited communication (such as letters, phone calls or email messages).

We have personal information retention processes designed to retain personal information of our customers for no longer than necessary for the purposes stated above or to otherwise meet legal requirements.

ACCESS TO YOUR PERSONAL INFORMATION

You have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. You may update your email address by going to the email sign-up page on our Websites and doing the following:

  • Click on the “unsubscribe” link to delete your old email address, and
  • Return to the email sign-up page and sign-up using your new address.

You may request access, updating and corrections of inaccuracies in other personal information we have in our custody or control by emailing or writing to us at the contact information set out below. We may request certain personal information for the purposes of verifying the identity of the individual seeking access to their personal information records.

YOUR CONSENT IS IMPORTANT TO US

It is important to us that we collect, use or disclose your personal information only when we have your consent to do so. Your consent may be implied, deemed (using an opt-out mechanism) or expressed. We may collect, use or disclose your personal information without your knowledge or consent where we are permitted or required to do so by applicable law or regulatory requirements.

Typically, we will seek your consent at the time that we collect your personal information. In certain circumstances, your consent may be obtained after collection but prior to our use or disclosure of your personal information. If we plan to use or disclose your personal information for a purpose not previously identified (either in this Privacy Policy or separately), we will endeavor to advise you of that purpose before such use or disclosure.

You may change or withdraw your consent at any time, subject to legal or contractual obligations and reasonable notice, by contacting our Privacy Office using the contact information set out below. All communications with respect to such withdrawal or variation of consent should be in writing and addressed to our Privacy Office. If you withdraw or vary your consent, we may not be able to provide you with the communications and/or services you request through our Sites. For example, if you would like to receive our communications, but are not willing to provide your email address, we will not be able to fulfill your request.

Unless you advise us otherwise, through the access and use of our Sites, services and communications, you have consented to the collection, use and disclosure of your personal information as explained in this Privacy Policy.

CHANGES TO THE PRIVACY NOTICE

This Privacy Notice may be updated periodically to reflect changes to our personal information practices. The revised Privacy Notice will be posted on the Websites, and is available by requesting it from Store Management at our Stores. We strongly encourage you to please refer to this Privacy Statement often for the latest information about our personal information practices.

**If you choose to communicate with us via email, please be aware that email is not a 100% secure medium for sending any personal or confidential information to us. **
